Epitaph Giveaway OFFICIAL RULES 1. Eligibility: NO PURCHASE NECESSARY. The 5.1 Label Group Epitaph prize Giveaway (“Sweepstakes”) is limited to legal U.S. residents at least 18 years of age who reside and are physically located in the U.S. Employees of 5.1 Label Group, L.L.C., Epitaph, immergent Records, Silverline Records, and their respective agencies, suppliers or vendors involved in this Sweepstakes (hereinafter “Sweepstakes Entities”), and members of the immediate families or households of such persons, are ineligible to enter the Sweepstakes. 2. To Enter: Register at www.dvdlauncher.com between 12.01am Pacific DST October 15, 2005 and 11.59pm Pacific DST December 31, 2005. Information requested on the entry form consists of your first and last name, valid email address, birth date (to confirm age qualification), gender, zip/postal code and contest code. LIMIT ONE ENTRY PER PERSON AND PER EMAIL ACCOUNT. Information collected as part of entry process will be used for winner notification, announcement, and future notification of new release information. In the case of any dispute about the identity of the entrant, the entry will be deemed submitted by the authorized email account holder. If multiple entries from the same email address are received, only the first entry will be considered and subsequent entries will be disqualified. Entry constitutes acceptance of all rules. 3. Prizes: Three (3) Epitaph Pennywise Skatedecks will be awarded as First prize, estimated retail value of $100 each. 25 Epitaph T-shirts will be awarded as runner-up prizes. No substitution, transfer, or cash value. Prize consists of listed item only. Winner is responsible for any and all expenses, including taxes. 4. Drawing and Notification: Potential winners will be selected in a random drawing from among all eligible entries on or about January 10, 2005. Judges’ decisions are final and binding on all matters. Odds of winning depend on the number of eligible entries received. Winners will be notified by email at the address provided and a mailing address requested for verification and prize delivery. If email is returned undeliverable or if no emailed response is received within five (5) days from first attempt to notify, or if prize is returned as undeliverable, or if potential winner is found to be ineligible or for any reason does not or cannot comply with these Official Rules, prize will be forfeited in its entirety and an alternate winner selected by random drawing. All entries become Sponsor’s property and will not be returned. 5. Additional rules: Winner responsible for all taxes, including income tax. Potential winner may be required to execute a notarized Affidavit of Eligibility, a Liability Release, and a Publicity Release (“Affidavit/Release”), which, if required, must be received by Sponsor within ten (10) days from winner’s receipt of papers. Potential winner may also be required to provide satisfactory proof of age such as passport, driver’s license or birth certificate, or prize will be forfeited and alternate winner chosen. Entry and/or acceptance of prize(s) constitutes permission for the Sponsor and its affiliates to use the winner’s name, address (city, province) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation on-line, unless prohibited by law. All entrants and potential winners agree to comply with these Official Rules or forfeit any prize. Any person attempting to defraud or in any way tamper with this Sweepstakes and any person who does not comply with these Official Rules, will be ineligible for prizes and may be prosecuted to the full extent of the law. The contest is governed by U.S, and state of California law. All national and local U.S. laws and regulations apply. If, for reasons beyond the Sponsor’s control, the Sweepstakes is not capable of running as originally planned, such as tampering or infection by computer virus, Sponsor at its sole discretion, reserves the right to cancel or modify the Sweepstakes, without liability. Void where prohibited, restricted or taxed by law. 6. Disclaimers: Entrants agree that Sweepstakes Entities shall not be liable for losses or injuries of any kind resulting from use of DVDLauncher.com, acceptance/possession and/or use/misuse of prize(s), participation in Sweepstakes, or any technical malfunctions of the telephone network and/or transmission line, computer on-line system, computer dating mechanism, computer equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules. Entrants also agree that the Sweepstakes Entities are not responsible or liable for any injury or damage to an entrant’s or third person’s computer related to or resulting from Sweepstakes and its prizes. The Sweepstakes Entities are not liable for damage to a user’s computer system in any way due to an entrant’s participation in the Sweepstakes or downloading any information in connection with the Sweepstakes, including without limitation any server failure, lost, delayed or corrupted data or other malfunction. The Sponsor reserves the right to modify or cancel the Sweepstakes in the event that it becomes technically corrupted. 7.
